General Terms and Conditions

This document contains the general terms and conditions governing the use of the online table reservation platform operated by Bevida Kft. as the Service Provider in connection with the Citymatiné event (hereinafter: the “GTC”).

Please use our services only if you agree with all provisions of these GTC and consider them binding upon yourself.

1. General information, formation of the contract between the Parties

1.1.

These GTC apply to all electronic commerce services provided within the territory of Hungary through the Service Provider’s online table reservation system. An online reservation qualifies as a contract concluded electronically, to which, in particular, Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services and certain issues of information society services, and other applicable Hungarian laws shall apply.

The Service Provider informs Users that certain consumer protection provisions may apply differently to the use of this service and to the contract between the Parties, particularly because the reservation concerns a leisure service linked to a specific date or period.

1.2. Buyer / User

The Buyer or User is any natural person or legal entity who initiates a table reservation through the Service Provider’s official online platform, submits the reservation and receives confirmation thereof, and acknowledges and accepts these GTC as binding upon themselves.

2. Purpose of the General Terms and Conditions

These General Terms and Conditions set out the general terms governing the legal relationship between the Service Provider and the Buyer entering into a contractual relationship with it. Matters not regulated herein shall be governed by the applicable laws of Hungary in force at the relevant time, official regulations, and the provisions of the Civil Code.

2.1. Acceptance of the contractual terms

Acceptance of these Terms and Conditions by the Buyer is a prerequisite for making a table reservation. The Terms and Conditions shall be deemed accepted when the Buyer ticks the checkbox for accepting the GTC during the online reservation process and finalizes the reservation.

2.2. Scope of the contractual terms

The Service Provider is entitled to amend these GTC unilaterally. Such amendments shall not affect contracts already concluded. The current Hungarian version of the amended GTC shall be continuously available on the Service Provider’s website.

The amendment shall enter into force on the 10th calendar day following its publication, unless the Service Provider specifies a later effective date.

The Service Provider may make previous versions of the GTC available for download with date indication.

3. The service

The Service Provider provides the possibility of online table reservations in connection with the Citymatiné event under the conditions set out in these GTC.

3.1. Territorial scope of the service

The online table reservation system operated by the Service Provider is accessible from both within Hungary and from abroad.

3.2. Scope of services available for purchase

On the online platform, the Service Provider shall provide detailed information on the available table types, their descriptions, the entitlements associated with each reservation, and the applicable prices.

The Service Provider reserves the right to modify the offer, availability, placement of tables, and prices prior to finalization of the reservation.

4. Formation and amendment of the contract

4.1. General characteristics

The contract between the Buyer and the Service Provider is formed when the Buyer finalizes the reservation during the online reservation process, accepts the GTC, and successfully pays the full reservation fee.

The Buyer shall receive information on the reservation and its confirmation by e-mail.

4.2. Subject matter of the contract

The subject matter of the contract is the provision of the reservation right relating to a specific table for the Citymatiné event and the related services.

5. Ordering / table reservation process

5.1.

Table reservation is possible exclusively by electronic means. The User selects the desired table type from the displayed list, provides the necessary data, accepts the relevant terms, and then finalizes the reservation by online payment.

Before submitting the order, the User has the opportunity to check and correct the data provided by them.

5.2.

The User selects the event date for which they wish to reserve a table.

5.3.

The User selects the table type.

5.4.

The User specifies the number of guests related to the reservation.

5.5.

The User accepts the entry rules, house rules applicable to the event, and the provisions of these GTC.

5.6.

The User provides the billing details.

5.7.

The User accepts the terms related to the use of the Stripe payment system, where such terms are displayed during the payment process.

5.8.

The User pays the full reservation amount online by bank card.

5.9.

By submitting the order, the User declares that they have read, understood, accepted, and acknowledge these GTC as binding upon themselves.

6. Payment terms

6.1. Online card payment via Stripe

The total amount of the reservation shall be paid by the Buyer by bank card through the electronic payment interface provided by Stripe. Payment is made on Stripe’s secure page. The Service Provider does not have access to bank card details; such data are handled exclusively by the payment service provider.

Successful payment is a condition for the reservation to be concluded.

6.2. Payment security

Card transactions are processed within the Stripe system via a secure, encrypted connection. The Service Provider does not receive the content of the payment page, and the bank card data required for payment are handled exclusively by the payment service provider.

The Buyer shall receive electronic confirmation of the transaction result after payment.

6.3. Full prepayment

Table reservations are valid only with full prepayment. The Buyer must pay the full reservation amount online before arriving at the venue.

7. Special terms applicable to table reservations

7.1. Content of the table price

The table price applies to the number of guests indicated for the given table type.

The table price includes:

  • the specified number of On Stage admission tickets assigned to the relevant table,
  • bottle service,
  • the possibility of using a separate entrance,
  • access to the private VIP and On Stage bars,
  • use of the VIP restrooms.

7.2. Consumable amount

The part of the table price exceeding the value of the admission tickets is fully consumable on site, in accordance with the drink menu and consumption conditions determined by the Service Provider or the operator appointed by it.

7.3. Additional guests

The number of guests attached to a reservation may be increased subject to the Service Provider’s approval and capacity. In the case of additional guests, the Service Provider may charge a per-person table fee.

7.4. Claiming the table

Guests must claim the reserved table no later than 18:00. If the reservation holder or their party does not claim the table by this time, the reservation shall become invalid.

7.5. Consequences of late arrival

If the table is not claimed by 18:00, the Service Provider is entitled to resell the table or make it available to other guests. In such a case, the Buyer shall not be entitled to any refund, damages, or other compensation.

7.6. Admission, face control

Guests holding an On Stage table reservation are also subject to the event’s face control and admission policy. The Service Provider and the event security staff reserve the right to refuse entry, particularly in the event of inappropriate attire, aggressive or undesirable behavior, intoxication or drug influence, or breach of the house rules.

7.7. House rules

All guests arriving with a table reservation are bound by the full house rules of the event and all entry rules. Violation of the house rules may result in refusal of entry or removal from the event premises.

8. Cancellation, modification, refund

8.1.

A table reservation is a service for a specific date and time; therefore, following finalization of the reservation and successful payment, the reservation may only be modified or cancelled at the sole discretion of the Service Provider.

8.2.

As a general rule, the table reservation fee already paid is non-refundable, including cases where the Buyer or their guests do not attend the event, arrive late, or fail to claim the table by 18:00.

8.3.

If the event is cancelled or materially modified due to reasons beyond the Service Provider’s control, force majeure, official measures, or organizer decisions, the Service Provider shall provide separate information on any applicable rescheduling, credit, or refund conditions.

9. Liability

9.1.

Guests are obliged to use the venue, furnishings, and elements of the service properly and for their intended purpose.

9.2.

The Buyer and the guests attached to the reservation shall be liable for any damage they cause at the venue, to the table, to equipment, or to third parties.

9.3.

The Service Provider shall not be liable for any items, valuables, clothing, or personal belongings brought by guests.

10. Complaint handling

For complaints related to the operation of the website, the reservation process, payment, or the service, the Buyer may contact the Service Provider at the following details:

The Service Provider shall examine verbal complaints immediately and remedy them where necessary, if the nature of the complaint allows. If immediate investigation of the complaint is not possible, the Service Provider shall draw up a record of the complaint and provide or send a copy thereof to the complainant.

The Service Provider shall respond substantively to written complaints within the statutory deadline.

The Service Provider shall retain the complaint record and a copy of its response for the period required by law.

11. Other legal remedies

If a consumer dispute cannot be resolved through negotiations with the Service Provider, the Buyer shall be entitled to pursue the following remedies:

  • filing a complaint with the consumer protection authority,
  • initiating proceedings before a conciliation body,
  • initiating court proceedings.

11.1. Conciliation body

The conciliation body is a forum for the out-of-court settlement of consumer disputes.

11.2. Court proceedings

The Buyer is entitled to enforce their claims before a court in civil proceedings in accordance with the applicable laws of Hungary.

12. Final provisions

12.1.

Any legal relationship arising from this Agreement shall be governed by the laws of Hungary. The Parties agree that Hungarian courts shall have jurisdiction to resolve any disputes arising in connection with this Agreement.

The Parties undertake to cooperate in good faith and to attempt to resolve any disputes amicably in the first instance. In the absence of an amicable settlement, disputes shall be resolved by the competent court specified in Section 11.2.

12.2.

The Service Provider reserves the right to amend the table reservation conditions, service elements, entry rules, and house rules applicable to the Citymatiné event within the framework of the applicable laws.

12.3.

By finalizing the reservation, the Buyer declares that they have read and accepted these GTC.
